The Colorado judiciary comprises the seven-member state Supreme Court, the Court of Appeals, district courts encompassing one or more counties, and county courts. The chief justice of the Supreme Court is the head of the state’s judicial branch. In addition, the constitution calls for juvenile and probate courts, as well as municipal courts, which provide the grassroots core of the judicial system. The judiciary also comprises seven special courts that adjudicate conflicts over water resources.

The district court holds original jurisdiction in all equity cases, probate, divorce proceedings, naturalizations granted by the county court, coroner’s inquests, civil cases, criminal cases, adoptions, juvenile cases, and paternity suits. Denver is the only district in Colorado that has separate probate and juvenile courts.

County courts handle civil cases involving no more than $15,000, misdemeanors, bonds, preliminary hearings, and traffic cases. County judges also issue search warrants and restraining orders.

The county court, created by the 1876 state constitution, retains jurisdiction of all matters of probate. Researchers can expect to find indexes to probate records, case files of probate records, administration of estates including record of wills, letters of testamentary and administration, appraisements, inventories, sales records, and guardianships. These records are held at the county level, although some early records have been deposited with the Colorado State Archives.

Tax records in Colorado may be found in a variety of locations. Some are located in the treasurer’s office at the county level, while others have been moved to libraries, historical societies, or the state archives. Others have been lost or, with permission of the state of Colorado, destroyed. A few dating to the 1870s or earlier have survived. The researcher may wish to check for an extant WPA Historical Records Survey for the county of interest. Otherwise, a search on an individual basis will be required.
