The State Archives and Historical Research Library (see Archives, Libraries, and Societies) holds some federal district court records for Dakota Territory from 1861 through 1889 on microfilm and some county level court records. However, the county’s clerk of the district court is responsible for juvenile court records, naturalization records, coroner’s juries and records, civil actions, jury lists, justice of the peace records, liquor applications for medical use, judgment records, and criminal proceedings.

The district court has original jurisdiction for probate and testamentary matters, the appointment and removal of administrators and guardians, and other probate action. Marriage licenses are issued by the county judge, who keeps those records on file. Request these records from the county clerk of court. Insanity records are also maintained in the office of the county judge.

North Dakota Naturalization Records

Most of North Dakota’s naturalization records have been transferred from the clerk of the district court offices in each county to the State Archives and Historical Research Library. These records represent the bulk of documentation pertaining to immigration and naturalization proceedings in the state. The records document individuals who became, or applied to become, citizens between 1873 and 1952. An index to all fiftythree county naturalization records can be found on the State Historical Society of North Dakota’s website.

The county auditors have possession of the tax rolls in North Dakota. Some rolls date from statehood and/or organization of the county and may be available at the State Archives and Historical Research Library and the special collection at the Chester Fritz Library (see Archives, Libraries, and Societies).
