The county court had original jurisdiction over all matters of probate, guardianship, and settlement of estate, as well as civil and criminal jurisdiction as may be conferred by law. The circuit courts held some case files, judgments, and depositions related to civil and criminal actions, naturalization records, and juror lists. In November 1972, the state’s constitution covering the Judicial Department was amended to create a unified judicial system. All judges then became either circuit court judges or state supreme court judges. This eliminated former county or district courts.

Many of the counties simply left their old files with the clerk of the courts in the county. However, the state archives in Pierre has notified all counties that they can transfer their old files to the archives. A few South Dakota counties have turned over some of their court records to the state archives, which also holds criminal dockets for Huron, Beadle County (1919–23); Jones County (1919–39); Mellette County (1912–57); and Minnehaha County (1890–96, 1923–73) with police dockets (1884–1909).

Wills and intestate proceedings originate at the county in which the deceased lived, usually at the county clerk of the court’s office. Some have been transferred to the state archives at the Cultural Heritage Center, cataloged under Unified Judicial System, Circuit Courts, Division of [County name] County.

Many probate records for Indian agencies have been microfilmed and are available through the FHL. Those that have not will be available through the National Archives.

Most tax lists that have survived are housed at the county seat in the auditor’s office. A few early tax records have been microfilmed and remain at the South Dakota State Historical Society, including those of “Old Stanley County,” comprised of presentday Stanley, Haakon, and Jackson counties. The microfilms for tax records are not always easy to read, but can include county commissions work in selecting juries, docket books, and real and personal property taxes. Others at the archives include Huron; Beadle County (1883–1902); Edmunds (1887–1924); Roberts (1884–1929); Stanley (1891–1930); Union (1870–1901); and delinquent tax lists from Walworth (before 1899).
